Staging Services

Effective upon Acceptance & Payment

These Terms and Conditions apply to all services provided by Staging.co.nz (“we”, “us”, or “our”). By engaging our services, you (“the Client”, “you” or “your”) agree to be bound by the following terms.

  1. Scope of Staging Services

1.1 The Client engages Staging.co.nz to provide home styling and staging services in accordance with our published offerings or quoted services and agrees to pay all associated service fees (“Fees”).

1.2 A binding contract is formed when the Client selects a staging service and makes full payment (or as otherwise agreed in writing).

1.3 While staging is a collaborative process, Staging.co.nz retains full creative control over the selection, placement, and arrangement of all final staging furniture and decorative items (“Staging Items”).

1.4 Any post-installation changes requested by the Client (such as re-styling or alterations) may incur additional charges and are subject to availability. All fees for changes must be paid in advance.

1.5 The Client agrees to ensure that all Staging Items are used appropriately, remain indoors, and are kept in good condition throughout the staging period.

1.6 Staging Items must not be moved from the property (“Staging Site”) without written approval from Staging.co.nz.

1.7 If any Staging Item is damaged, stained, lost, or destroyed (other than through fair wear and tear or the fault of Staging.co.nz), the Client is responsible for the full cost of cleaning, repair, or replacement, including transport and labour costs.

1.8 The Client must maintain utilities (including power) at the Staging Site throughout the agreed staging period.

1.9 The Client must not carry out maintenance, painting, or internal repairs while Staging Items are in place if such activities pose a risk of damage.

1.10 Staging Items must not be handled, moved, or rearranged by anyone other than authorised representatives of Staging.co.nz.

1.11 The Client must ensure that Staging.co.nz has unrestricted access to the Staging Site at all times until the staging period ends and all Staging Items are removed.

  1. Delivery of Staging Items

2.1 Delivery and installation dates will be scheduled by agreement between the Client and Staging.co.nz.

2.2 Changes to the agreed delivery date are subject to availability and must be approved by Staging.co.nz in writing.

2.3 Additional fees may apply for any rescheduling or delivery changes, which must be paid in advance. Unpaid change fees may be deducted from any deposit paid.

2.4 If the Staging Site is unsafe, unclean, or unsuitable (e.g. exposed to the weather), Staging.co.nz may postpone delivery or installation. The Client will be notified in writing of the issue.

2.5 Following a notice under clause 2.4, the Client must respond within five (5) business days to:
• Confirm their intention to proceed and pay any extra costs; or
• Cancel the booking, in which case any deposit may be forfeited.

2.6 The Client authorises Staging.co.nz to hang or install wall art and accessories as part of the staging process.

  1. Property Access

3.1 The Client must ensure that Staging.co.nz and its representatives have full access to the property throughout the staging period for installation, inspections, and removal of Staging Items.

3.2 If the Client is not the legal property owner, they must obtain and provide all necessary permissions to access and stage the property.

  1. Removal of Items

4.1 The Client must provide at least five (5) business days’ written notice if they wish to extend the staging period or request item removal. Otherwise, Staging.co.nz may remove items at the end of the original period without further notice.

4.2 If the Client sells the property before the end of the staging period and requests early removal, a minimum of five (5) business days’ notice is required. No refund will be issued for the unused period.

4.3 Staging.co.nz is not responsible for minor wear and tear from normal use of Staging Items, including:
• Nail or hook holes in walls;
• Carpet indentations;
• Scuff marks or similar effects caused by furniture placement.

  1. Extensions

5.1 The Client may request an extension of the staging period with a minimum of five (5) business days’ notice prior to the expiry date. Extensions are subject to availability.

5.2 If granted, extension fees must be paid within three (3) business days from the start of the extension. Failure to pay on time may result in removal of Staging Items.

  1. Damage & Care

6.1 The Client must immediately notify Staging.co.nz of any damage or accident involving Staging Items.

6.2 If any issues or defects are discovered upon delivery, the Client must report them in writing within three (3) business days.

6.3 Staging.co.nz must be allowed reasonable access (minimum of five business days) to inspect and, if applicable, repair or replace any affected items.

6.4 The Client agrees to maintain all Staging Items in clean and undamaged condition, returning them in the same condition as delivered, allowing for fair wear and tear.

6.5 The Client acknowledges and accepts that hooks or fasteners may be used to install artwork or items and that touch-ups after removal are the Client’s responsibility.

  1. Fees & Payments

7.1 All fees must be paid in full before service delivery unless otherwise agreed in writing by Staging.co.nz.

7.2 Payments must be made to the bank account or via payment methods advised by Staging.co.nz.

7.3 Failure to make payment may result in cancellation, delay, or refusal of service without liability to Staging.co.nz.

7.4 All fees are exclusive of GST unless otherwise stated. Invoices will be issued for all payments.

7.5 Refund Policy:
• No refunds are provided for cancellations made by the Client.
• If Staging.co.nz cancels prior to delivery for reasons unrelated to Client conduct, prepaid amounts will be refunded within ten (10) business days.

  1. Promotional Use of Imagery

8.1 Staging.co.nz may photograph the property before or after staging for marketing, portfolio, or promotional use.

8.2 The Client consents to the use of the property address for promotional purposes.

8.3 The Client may use photos of staged areas for their own marketing or sales listings of the property.

  1. Termination

9.1 This agreement ends upon completion of services or as otherwise agreed in writing.

9.2 Either party may terminate this agreement with at least five (5) business days’ written notice.

9.3 Staging.co.nz may cancel services before delivery for any reason without liability.

9.4 Immediate termination is permitted if a party:
• Commits a serious or irremediable breach;
• Fails to remedy a breach within five (5) business days of written notice;
• Repeatedly breaches any term of this agreement.

9.5 If the Client terminates this agreement without cause, they remain liable for full fees and charges incurred to date.

9.6 If the Client breaches this agreement, Staging.co.nz may recover its property with a minimum of five (5) business days’ notice. The Client agrees to indemnify Staging.co.nz for any resulting losses or expenses.

  1. Liability & Indemnity

10.1 All use of Staging Items is at the Client’s risk.

10.2 Staging.co.nz is not responsible for the actions or negligence of third parties present at the property during the staging period.

10.3 The Client agrees to indemnify Staging.co.nz from any loss or damage resulting from misuse or unauthorised handling of Staging Items or breach of this agreement.

10.4 To the extent permitted by law, Staging.co.nz excludes all liability for indirect, consequential, or incidental damages, including loss of opportunity or profits.

10.5 Nothing in this agreement limits rights under the Consumer Guarantees Act 1993. Where permitted, Staging.co.nz’s liability is limited to:
• Re-supply of services or associated cost; or
• Repair or replacement of goods or associated cost.

10.6 In any case, the maximum liability of Staging.co.nz is limited to the total amount paid by the Client for the staging service.

10.7 The Client releases and indemnifies Staging.co.nz, its team, and contractors from all claims relating to staging activities, property access, or use of Staging Items.

  1. Communications

11.1 All Client communications must be sent to the contact details provided on the Staging.co.nz website.

11.2 All notices from Staging.co.nz will be sent to the Client’s latest provided contact details.

11.3 The Client must ensure their contact information remains current throughout the term of this agreement.

  1. General Provisions

12.1 Ownership of all Staging Items remains with Staging.co.nz at all times.

12.2 If any term in this document conflicts with a quote or proposal, the quote or proposal takes precedence.

12.3 No amendment is valid unless agreed in writing by both parties.

12.4 Staging.co.nz may assign or subcontract obligations at its discretion. The Client may not assign rights without written consent.

12.5 This document contains the entire agreement between the parties.

12.6 Nothing in this agreement creates a partnership, joint venture, or employment relationship.

12.7 A failure to enforce any term does not waive that term.

12.8 If any part of this agreement is deemed invalid, the remaining parts remain in effect.

12.9 This agreement is governed by the laws of New Zealand, and any disputes will be subject to the jurisdiction of New Zealand courts.

12.10 Time is of the essence in the performance of all obligations.

12.11 Communications and execution may occur electronically and remain binding.
